Lockport man pleads guilty to his sister’s death

A Lockport man pleaded guilty to second-degree murder in the beating death of his sister last year, Niagara County District Attorney Brian D. Seaman announced.

David B. Fermoile, 65, will be sentenced to 20 years to life in prison when he returns for sentencing on December 11 before Niagara County Court Judge Caroline Wojtaszek.

Fermoile pleaded guilty to causing the death of Diane F. Fermoile-McAvoy, 68, of Continental Drive in Lockport, on June 7, 2023, in the home he shared with their mother, Marilyn A. Fermoile, on Windermere Road in Lockport.

Fermoile was arrested at their residence when sheriff’s deputies stopped by to check on him after a call from a visiting nurse who was unable to make contact with his mother.

Deputies said they found Fermoile-McAvoy dead on the floor with injuries to his head and face. Marilyn Fermoile, who was found safe and sound that day, died on January 23 at the age of 99.
